Terms of Service

These Terms of Service ("Terms") govern your access to and use of the websites, applications, and related services offered by OpenHauz ("OpenHauz," "we," "us," or "our") (collectively, the "Service"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. Who may use the Service

You must be at least 18 years old and able to form a binding contract to use the Service. If you use the Service on behalf of a business or organization, you represent that you have authority to bind that entity to these Terms.

2. The Service

OpenHauz provides an online platform to discover real estate open houses and property-related events, explore listings, save properties, create and manage listings, RSVP to events, exchange messages with other users, receive notifications, and connect with real estate professionals where those features are available. We may modify, suspend, or discontinue any part of the Service at any time.

3. Accounts and security

You may need to register an account. You agree to provide accurate information and keep it current. You are responsible for safeguarding your credentials and for activity under your account. You may sign in using email and password.

We may use verification steps (for example, one-time codes sent to your email or phone) to help protect accounts and comply with applicable law.

OpenHauz is intended for users in the United States only.

4. User content and license to us

You may submit content to the Service, including profile information, listing details, descriptions, photos, messages, and other materials ("User Content"). You retain ownership of your User Content. You grant OpenHauz a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify, display, distribute, and otherwise use User Content as reasonably necessary to operate, improve, promote, and provide the Service, including showing listings and open house information to other users and the public as your settings and the product allow.

You represent that you have all rights needed to grant the foregoing license and that your User Content does not violate these Terms or any law.

5. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose or in violation of these Terms
  • Harass, abuse, defraud, or impersonate others, or scrape or systematically collect data from the Service without permission
  • Upload malware, attempt unauthorized access, or interfere with the Service or its infrastructure
  • Post false, misleading, or infringing listing or property information
  • Circumvent technical limits, security measures, or access controls

We may investigate violations and cooperate with law enforcement. We may suspend or terminate accounts that we believe have violated these Terms.

6. Listings, events, and real estate

Property listings, open house schedules, and related information are provided by users, agents, or third parties. OpenHauz does not guarantee the accuracy, completeness, or availability of any listing or event. The Service is not a substitute for professional advice (including legal, tax, or investment advice). Transactions occur between you and other parties; OpenHauz is not a party to your purchase, sale, lease, or agency agreement unless we expressly state otherwise in a separate written agreement.

7. Messages and communications

Messaging and notification features are provided for convenience. You consent to receive operational and, where applicable, marketing communications in accordance with our Privacy Policy and your preferences. You are solely responsible for the content of messages you send through the Service.

8. Fees

Certain features may be free or paid now or in the future. If we charge fees, we will describe pricing and billing terms before you incur charges, unless otherwise required by law.

9. Intellectual property

The Service, including its software, design, branding, and content (excluding User Content), is owned by OpenHauz or its licensors and is protected by intellectual property laws. Except for the limited rights granted in these Terms, no rights are granted to you.

10. DMCA and copyright

If you believe material on the Service infringes your copyright, please contact us at hello@openhauz.com with the information required under the Digital Millennium Copyright Act (DMCA) or applicable law. We may remove or disable access to material we believe violates these Terms or the law.

11. Third-party services

The Service may link to or integrate with third-party websites, maps, payment providers, or sign-in services. Those third parties have their own terms and privacy practices. OpenHauz is not responsible for third-party services.

12. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENHAUZ DISCLAIMS ALL WARRANTIES, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR FREE OF HARMFUL COMPONENTS.

13. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, OPENHAUZ AND ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM YOUR USE OF OR INABILITY TO USE THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE WILL NOT EXCEED THE GREATER OF (A) THE AMOUNTS YOU PAID TO OPENHAUZ FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM OR (B) ONE HUNDRED U.S. DOLLARS (US $100), IF YOU HAVE NOT HAD ANY PAYMENT OBLIGATIONS TO OPENHAUZ.

Some jurisdictions do not allow certain limitations; in those jurisdictions, our liability is limited to the fullest extent permitted by law.

14. Indemnity

You will defend, indemnify, and hold harmless OpenHauz and its affiliates, officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of your User Content, your use of the Service, or your violation of these Terms or applicable law.

15. Termination

You may stop using the Service at any time. We may suspend or terminate your access if you violate these Terms or if we need to protect the Service or other users. Provisions that by their nature should survive will survive termination (including ownership, licenses granted to us for User Content as needed to operate archival or legal obligations, disclaimers, limitations of liability, indemnity, and dispute resolution).

You may request to close your account through the in-product flows described in our help materials (for example, Profile → Settings → Delete Account), subject to our verification and legal retention requirements.

16. Governing law and disputes

These Terms are governed by the laws of the State of California, excluding conflict-of-law rules. You and OpenHauz agree that the state and federal courts located in San Francisco County, California will have exclusive jurisdiction for disputes arising from these Terms or the Service, subject to any mandatory consumer protections in your place of residence.

17. Changes

We may update these Terms from time to time. We will post the updated version and revise the "Last updated" date. If a change is material, we will provide additional notice as required by law. Your continued use of the Service after the effective date constitutes acceptance of the updated Terms.
